Responsibilities

  • Develop and/or maintain a working knowledge of all potentially applicable cybersecurity laws, regulations, and binding industry frameworks, including but not limited to PCI-DSS, the GLBA Safeguards Rule, the HIPAA Security Rule, the NYDFS Cybersecurity Regulation, the SEC’s Cybersecurity Incident Reporting Rules for Public Companies, CIRCIA and the related rules under development by CISA, the laws of EU member states implementing the NIS2 Directive, the California Privacy Protection Agency’s forthcoming rules regarding cybersecurity audits, and various US state laws requiring the implementation of reasonable security controls.Β 

  • In the event of a cybersecurity incident, work closely with the information technology and information security functions, including by managing investigations performed under privilege by the critical incident management and digital forensics teams.Β 

  • Work closely with the Deputy Chief Privacy Officer and with the compliance and enterprise risk management functions to review enterprise risks related to information technology and/or information security and evaluate the legal sufficiency of proposed remediation plans.Β 

  • Participate in the annual review and update process for the Company’s information security policies, plans, standards, and playbooks, and provide other strategic and legal guidance to information security leadership on program design and implementation.Β 

  • Support Privacy Office and Legal Department colleagues in the negotiation of customer- and vendor-facing security exhibits and in the development of product- and business-specific security exhibit templates for use by corporate counsel.Β 

  • Provide legal support to internal investigations and contribute to the refinement of processes and procedures governing the same.Β

Qualifications, Skills & Experience
Β 

Professional Qualifications:

  • J.D. degree with strong academic performanceΒ 

  • 4-7 years of experience practicing law (exceptional candidates outside these bounds may be considered)

  • Licensed to practice law in the US
    Β 

  • Subject-matter expertise in the cybersecurity, privacy, and/or incident response practice areas expected; experience conducting or supporting internal investigations a plus

  • Experience advising senior business leaders on sensitive matters

  • Experience negotiating and drafting privacy and security exhibits for customer- and vendor-facing contracts

  • Flexibility and willingness to work on a broad variety of legal matters

  • Excellent oral and written communication skills

  • Ability to work collaboratively with business partners across levels and show leadership in cross-functional teams

Desired Skills & Experience:

  • Experience in the payments industry or financial services industry

  • Ability to engage in technical discussions with IT teams

  • CIPP/US and/or CIPP/E certification
